HOW TO GIVE YOURSELF THE BEST CHANCE TO WIN YOUR PENNSYLVANIA COMPENSATION CASE

case[1]Many times your workers compensation case is won or lost before you even enter the courtroom. Here are some tips to maximize your chance for success:

  1. Immediately report the injury no matter how insignificant it may be. DO NOT assume that “everyone knows” that you were injured. Memories fade and co-workers often “forget” that you informed them of an injury.

  2. Keep a journal of who from the Employer you told about your injury and what you told them. Pennsylvania Workers’ Compensation requires you to tell someone in authority such as a, Supervisor, line leader, safety coordinator, company nurse or someone in Human Resources that you were injured. This is called “NOTICE”. It is the foundation upon which your case is built. You only have 120 days to provide notice.

  3. Complete an accident report with one of the aforementioned individuals within 120 days.

  4. Seek immediate medical attention and explain exactly how and where you were hurt. If you fail to tell your doctor that you were hurt at work and how you were hurt that could be used against you. Likewise, make sure you provide a description of where your pain is located.

  5. Ask to review your medical notes before you leave the doctor’s office and confirm that the information is correct and that there is an indication on the notes that a work related injury occurred.

  6. If you or your doctor don’t think you can do your regular job, make sure you get, a note from your doctor stating what your restrictions are or If you can’t work a note confirming the need for time off due to your work related injury.

  7. If you had a previous injury to the same area of your body where your new work related injury is, make sure you can distinguish how symptoms from the old injury are different from the symptoms from the new work injury.
