Reading Workers Comp Benefits Lawyer
All employees, regardless of their line of work, face the possibility of becoming hurt while they are at work. If you have been hurt and your injuries are serious enough to prevent you from working, you may be able to file a workers’ compensation claim. Unfortunately, obtaining the benefits you rightfully deserve is not easy and so, you should always work with a Reading workers comp benefits lawyer who can help you through the process. Below, our experienced attorney explains the benefits you may be entitled to.
Medical Expenses
Any medical expense you incurred as a result of your workplace injury or illness is covered under workers’ compensation in Pennsylvania. Coverage for medical expenses is extensive and includes medical devices, doctors’ visits, medications, as well as modifications you need to make to your home or vehicle to accommodate the injury. There are no monetary or time restrictions on the coverage of medical expenses for a workplace injury or illness.
Travel Expenses
If you need to travel outside of Reading or your place of residence for medical treatment, you can be reimbursed under the workers’ compensation system. If you cannot get to medical treatment on your own, the insurance company representing your employer must provide you with transportation to and from the treatment you need.
Temporary Total Disability Benefits (TTD)
If you are unable to return to work due to your injury, you are eligible for temporary total disability benefits (TTD). This coverage is equivalent to two-thirds of your lost wages. If your injury prevents you from working for 104 weeks, or two years, the insurer may require you to undergo an Impairment Rating Evaluation (IRE). If the evaluation determines that you have less than 50 percent total body impairment, the insurer will classify you as being partially disabled.
Partial Disability Benefits
If, after the IRE, it is determined that you are partially disabled, or the physician for the insurance carrier determines that you can return to light duty work, you may be eligible for partial disability benefits. Partial disability benefits apply if you have the ability to earn some wages but you have not fully recovered. If your new position does not pay as much as what you earned prior to your accident, you have the right to receive two-thirds of the difference.
Specific Loss Benefits
If your workplace accident resulted in the loss of vision or hearing, the loss of a body part, or you suffered serious disfigurement to your head, face, or neck, you have a right to receive specific loss benefits. These benefits are equivalent to any TTD benefits you received during a specific period of time while you recovered.
Death Benefits
If you lost a loved one due to a workplace accident, you have the right to receive death benefits. These benefits include $3,000 in funeral costs and you must receive them within 300 weeks of the date of injury.
